In this Agreement, the party who is contracting to provide services shall be referred to as "A Tailored Event" and the party who will be receiving the services shall be referred to as "The wedding couple and/or agent". A Tailored Event represents that they have extensive background in all aspects of wedding/event coordination and access to a full range of pertinent product and service contacts in the Clearwater, FL and surrounding area. A Tailored Event is willing to provide services based on this background. The wedding couple or agent of couple represents that the couple plans to be married on ______________________ and they desire to have wedding/event coordination, and related products and services provided by A Tailored Event. There may also be additional charges above and beyond those set forth in paragraph 2 above. The deposit(s) made to date will transfer over to the new date if the requested date is available. The wedding couple further understands that last minute changes can impact the quality of the event and that A Tailored Event is not responsible for these compromises in quality. If a date change is required, a new contract must be signed by both parties showing the changes. 4) CANCELLATIONS: As we have secured this date for the wedding couple or agent and made this date/time unavailable for other customers, all deposits/payments made to date are non-refundable. In the event of a cancellation, the wedding couple must sign a form stating that the event date was canceled. 5) REMEDIES: In the event A Tailored Event is unable to collect the required payments for any reason the following will apply: (a) Day 1-15: All coordination efforts will cease (b) Day 16: All location and sub-contractor reservations made on behalf of the wedding couple will be canceled and collection efforts for any remaining debt to A Tailored Event will commence. 6) CHANGES/FINALIZATION TO ORDER: The wedding couple agrees that if any changes are made to current order, a new contract and invoice must be signed outlining the requested changes. The wedding couple or agent must have all final changes made within (3) weeks of the wedding date. It is the customers responsibility to notify A Tailored Event of any changes being made to original order, billing address, delivery address, setup location, phone or email address within (3) weeks of the event date. All orders may be up or down sized by 15% of the original order within (3) weeks of the event date which after that time the order becomes final. 7) OUTDOOR LOCATIONS: The wedding couple understands that A Tailored Event provides certain outdoor wedding locations by special permit from the county, city or state agencies. The wedding couple agrees that they and their invited guests will abide by the permit requirements. Furthermore, the wedding couple is responsible to inquire if a permit or temporary use permit is required for their wedding location from the city/county authorities. If a permit is required, the wedding couple agrees to pull their own permit and make all arrangements and payment(s) to the city/county authorities. Permit/Permit fee(s) are NOT included in A Tailored Event services or fee(s), this is the sole responsibility of the wedding couple/agent. A Tailored Event is not responsible if the wedding couple or agent fails to check with the local city or counties to inquire if a special permit is required for their requested setup location. Furthermore, A Tailored Event will not be held responsible if a local city or county officer does not allow us to setup at the requested location or requires us to take down the rental items due to failure of the wedding couple or agent not inquiring if a permit is required. In the event that this happens, all deposits/payments made to date are non-refundable. 8) ENTIRE AGREEMENT: This Agreement contains the entire agreement of the parties except as noted in paragraph 6 above, and there are no other promises or conditions in any other agreement whether oral or written. This Agreement supersedes any prior written or oral agreements between the parties. All agreements must be outlined in the contract and signed by both parties. 9) AMENDMENT: This Agreement may be modified or amended if the amendment is made in writing and is signed by both parties. 10) SEVERABILITY: If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited. 11) WAIVER OF CONTRACTUAL RIGHT: The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement. 12) APPLICABLE LAW: This Agreement shall be governed by the laws of the State of Florida. 13) RESPONSIBILITY FOR USE & DISCLAIMER OF WARRANTIES: You are responsible for the use of the rented item(s). You assume ALL risks, whether obvious or not, in the delivery, set-up, operation, dismantling, and use of the item(s) and agree to assume the entire responsibility for the defense of, and to pay, indemnify and hold  A Tailored Event , its principles, and employees harmless from, and hereby release  A Tailored Event , its principles and employees from, any and ALL claims for damage to property or bodily injury (including death) resulting from the delivery, set-up, use, operation, dismantling or possession of the item(s), except to the extent it may be proven and/or found that such damage or injury resulted in whole or in party from the negligence of  A Tailored Event , its principals, and/or employees or from the defective condition of the item(s) which is known to  A Tailored Event , its employees or agents at or before the time the item(s) are placed in your possession. YOU AGREE THAT NO WARRANTIES, EXPRESSED OR IMPLED, INCLUDNG MARCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE HAVE BEEN MADE IN CONNECTION WITH THE EQUIPMENT RENTED OR USED FOR DECORATING PURPOSES. CLIENT DISCLAIMS ALL WARRANTIES IN THE CONNECTION WITH THE DECORATING/RENTAL EQUIPMENT, EXPRESS OR IMPLIED AS TO ANY MATTER WHATSOVER, INCLUDING WITHOUT LIMITATION DESCRIPTION, QUALITY, DESIGN, PERFORMANCE, SPECIFICATIONS, CONDITION, MERCHANTABILITY, AND FITNESS FOR ANY PARTICULAR PURPOSE, EXCEPT AS SET FORHT IN THIS CONTRACT. 14) DAMAGED, THEFT OR LOST ITEMS: The wedding couple agrees to pay for any damage to or loss of rental/decorating items, if resulting out of negligence from the wedding couple or guests. 15) TITLE/OWNERSHIP: The equipment is, and at all time shall remain, the sole and exclusive property of A Tailored Event, and the wedding couple shall have no right to purchase or otherwise acquire title of ownership of any rental /decorating equipment. 16) INDEMNITY: Client shall indemnify A Tailored Event against and hold harmless against any claims, actions, suits, proceedings, costs, expenses, damages, and liabilities, including attorney s fees and court cost, arising out of, connected with, or resulting from A Tailored Event or clients use of rental equipment. 17) WAIVER OF CONTRACTUAL RIGHT: The failure of either party to enforce any provision of this agreement shall not be construed as a waiver or limitation of that parties right to subsequently enforce and compel strict compliance with every provision of this agreement. 18) WEATHER CONDITIONS: A Tailored Event assumes no responsibility for inclement weather and/or acts of God. You agree to accept full responsibility of inclement weather and/or acts of God. Inclement Weather Waiver is NOT insurance and restrictions apply. You are responsible for this contract IN FULL if inclement weather cancels your event. No refunds will be given in this matter. If the wedding couple or agent request that a last minute setup be moved to a new location due to weather (within a 10 mile radius) -  ground floor ONLY , there will be an additional fee of $100.00 added to the invoice which is due prior to setup. Bamboo arch/Canopy are made for beach ceremonies which poles are buried in the sand. If bad weather requires you to move the bamboo arch/canopy to an indoor location, it will stand 10 high and must be placed inside planters with sand which is an additional $20.00 per planter/bucket. Any changes to the setup location due to inclement weather must be made within 6 hours of the setup time. Once the rental items are setup at the requested location, they cannot be moved to a new location.
